STANDARD TERMS AND CONDITIIONS OF VEHICLE RENTAL
1. Definitions and interpretations
1.1 The Rental Company means AMR Car Rental (Pty) Ltd, trading as Sea Point Car Hire.
1.2 The Renter means the Driver/s of the rental vehicle, as per the rental agreement.
1.3 The Vehicle means the vehicle rented by the Renter as per the rental agreement.
1.4 The Rental Period starts on the date on which the Renter takes delivery of the vehicle and concludes on the date that the vehicle is to be returned to the rental company, as per the rental agreement.
1.5 The Rental Company rents the vehicle to the Renter subject to the terms and conditions as outlined herein.
2. Risks and Liabilities
2.1 The vehicle shall be at the sole risk of the renter (fair wear and tear accepted) for the duration of the rental period as outlined in the rental agreement.
2.2 Any legal costs, collection or tracing charges incurred by the rental company in the event of legal action stemming from actions by the renter would be for the renter’s account.
2.3 The renter is liable for any fines for traffic infringements incurred during the rental period, plus an administration fee of R200 per fine.
3. Warranties
3.1 No other person other than the driver/s as approved in the rental agreement may drive the vehicle.
3.2 The renter will be charged a call out fee for negligence, example vehicle lights left on leading to the vehicle battery dying, etc.
4. Payment
The renter agrees to pay the rental company:
4.1 The vehicle rental rates as agreed between the renter and the rental company as per the rental agreement, plus any other fees and or changes as agreed to in terms of the rental agreement and outlined herein.
4.2 It is the policy of the rental company to hand-over the rental vehicle with a full tank of fuel. If the vehicle is not refueled prior to it being returned, the renter will be charged for the cost of fuel (full tank) as well as a surcharge of R100.
4.3 Mileage during rental period (calculation based on the rental period): free for the first 200km per day. Thereafter, R1.80 per km.
4.4 Should the renter fail to cancel the reservation at least four hours prior to the scheduled booking date and time, the renter will be liable for a cancellation fee of R200.
4.5 Should the rental vehicle be returned in a state that requires deep cleaning (including access beach sand in the interior of the vehicle), the renter will be liable for a cleaning fee of R250.
5. Waiver
5.1 The Renter shall be bound by the terms and conditions in terms of the rental company’s standard motor vehicle insurance policy applicable to excess waivers, in the event of theft, collision or other related incident during the rental period.
5.2 Excess waivers shall not include any damages resulting from incidents considered to be negligence by the renter, including:
5.2.1 travelling on roads with potholes, sand and gravel roads;
5.2.2 damage/loss incurred whilst driving under the influence; or
5.2.3 damage/loss if the vehicle is driven by an unauthorised driver.
5.3 The renter will be liable for the limited liability if the damage to the vehicle is deemed uneconomical to repair or where damage to the vehicle where no other vehicles were involved, or in the event that the vehicle is stolen or hijacked.
5.4 For long term rentals, i.e. 15 days and longer, it is recommended that the renter checks oil and water levels every 14 days. The renter will be liable for all damages as a result of negligence, for example not checking oil & water levels consistently.
5.5 The renter may not, under any circumstances, use the rental vehicle for any Uber/Bolt/passenger/delivery paying services.
6. Indemnity
6.1 Standard insurance cover is included with the vehicle rental at no additional charge to the renter. The renter may be liable for an excess of 10% for certain claims.
6.2 The renter indemnifies the rental company against any claims for any loss or damage to any person/s or property. This includes all items belonging to the renter that may be damaged or stolen from the vehicle.
6.3 Windscreen or tire damage due to negligence will be charged to the renter in full.
6.4 In the event of theft of the rental vehicle or a motor vehicle accident/collision, the renter is to contact the rental company immediately. The emergency contact number is +27 79 498 0731. Theft of the rental vehicle is also to be reported to the closest police station within 24 hours of the incident.
6.5 In the event of a collision/accident, the renter is requested to take photos of all vehicles involved in the accident, showing the damages, license disk/s, drivers license/s of other motorists involved, contact information of all involved, and obtain a complete accident report at the police station closest to the accident scene (within 24 hours). In the event of a major motor vehicle accident, the rental company will arrange for assistance at the accident scene.
6.6 The rental company has their own vehicle towing services. Should the vehicle need to be towed, the renter is NOT to allow any other towing company to tow the vehicle without the rental company’s consent. If the rental vehicle is towed by an unauthorised towing company, the renter will be liable for all related costs.
7. Termination
7.1 The Rental company shall be entitled to terminate the rental agreement at its sole discretion at any time should the renter breach any of the rental terms and conditions, at which point the renter shall return the vehicle to the rental company or to an authorized representative of the rental company.
8. General
The rental agreement is the entire agreement between the rental company and the renter, regarding matters contained herein as well as the vehicle checklist and these standard terms and conditions. By way of the Renter signing the agreement, it will be considered a legally binding agreement between the rental company and the renter.
